1. Eligibility and account responsibility

You must notify us immediately if you become aware of any unauthorised access to your account.

2. Service description

Yield Clarity provides financial planning and forecasting tools, educational content, and portfolio analysis features designed to help users model scenarios and assess financial independence and retirement planning assumptions. The Service is for general informational and planning purposes only and does not constitute financial, tax, legal, or investment advice.

3. Your responsibilities

You agree to use the Service lawfully and not to:

• Upload or transmit unlawful, harmful, abusive, misleading, or infringing content.
• Attempt to reverse engineer, interfere with, or compromise the Service or its systems.
• Use the Service to build a competing product or otherwise exploit the Service beyond permitted use.
• Access or use the Service in a way that violates applicable laws or regulations.

You remain solely responsible for any data, assumptions, and decisions you input into the Service and for the consequences of acting on the outputs or recommendations generated by the Service.

4. Subscription, fees, and billing

Some features of the Service may be available on a free or paid basis. If a paid plan is selected, fees will be billed using the payment method you provide in accordance with the pricing and billing terms shown at the time of purchase. We may change fees, features, or plans at our discretion, subject to any applicable notice requirements.

If payment is not made on time, we may suspend or terminate access to paid features. Unless otherwise stated, subscriptions are billed on a recurring basis and may be cancelled in accordance with the cancellation flow available in the Service.

5. Intellectual property

The Service, its content, design, software, trademarks, logos, and associated materials are owned by Swift Tech Stack FZCO or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may use the Service only for your personal or business use as permitted by these Terms.

You retain ownership of any data or content you input into the Service, but by using the Service you grant us the right to host, process, and use that content as necessary to provide and improve the Service in accordance with our Privacy Policy.

6. No financial advice

The Service, including calculations, models, projections, scenario outputs, and educational content, is provided for general informational and planning purposes only. It is not, and should not be treated as, financial, tax, legal, investment, or accounting advice, nor does it constitute a recommendation to buy, sell, or hold any asset or financial product.

Forecasts and projections depend on assumptions and may not predict future outcomes. Actual investment performance, inflation, taxes, market conditions, and personal circumstances may differ materially from the outputs generated by the Service. You should seek independent professional advice where appropriate.

7. Privacy and data protection

We process personal and financial information in accordance with our Privacy Policy. By using the Service, you consent to that processing and agree that we may collect, store, use, and disclose information as described there.

8. Availability, reliability, and warranties

The Service is provided on an “as is” and “as available” basis. We do not guarantee continuous availability, uninterrupted access, or error-free operation. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Swift Tech Stack FZCO and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of business, loss of profits, data loss, or similar losses, arising from your use of the Service or these Terms.

Our aggregate liability to you in connection with the Service shall not exceed the amounts actually paid by you to us for the Service in the 12 months preceding the event giving rise to the claim, or AED 1,000 if no fees were paid, whichever is greater.

10. Termination

We may suspend or terminate your access to the Service if you breach these Terms, misuse the Service, or fail to comply with applicable law. You may stop using the Service at any time. Upon termination, your right to access the Service ends, and we may delete or retain your data as required by law or our retention policies.

11. Changes to the Service or these Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. Material updates will be posted here and may be communicated by email or in-app notice where appropriate. Continued use of the Service after the updated Terms are posted constitutes acceptance of those changes.

12. Governing law and dispute resolution

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE, and you agree to submit to that jurisdiction.
